Farm Labor Survey Adverse Effect Wage Rates (AEWR) 2025

On November 20, 2024, the Farm Labor Surveys with the new Adverse Effect Wage Rates (AEWR) for 2025 were released. Nearly every state saw an increase in their year over year rates from 2024, except for Michigan, Minnesota and Wisconsin, which all saw minor decreases. Below you will find the new rates going into effect on January 1, 2025 for all states (except Alaska).
Efforts to challenge DOL’s 2023 AWER Rule remain ongoing and we anticipate additional lawsuits will be filed in the near future given the nearly across-the-board increases reflected in the 2025 AWER data. Today, NCAE announced that it filed a Writ of Mandamus in federal court in Washington, D.C. requesting that the Court direct DOL to respond to the petition for hearing that was filed back in December 2023 regarding DOL’s AWER methodology.
